Chapter 4 - The Bail Hearing

The air inside Courtroom 3B of the Manhattan Criminal Court was thick with tension. The gallery was packed to capacity with high-society observers, corporate executives, and press reporters. Everyone wanted a front-row seat to the scandal breaking open the Caldwell-Mercer empire.

I sat in the front row of the gallery behind the prosecution desk, accompanied by my lead civil attorney, Victoria Cross. Across the aisle at the defense table sat Blake and Judith.

Stripped of their designer clothes, both were dressed in bright orange institutional jumpsuits. Blake looked gaunt and hollowed-out, his hair unstyled, while Judith sat rigid, refusing to make eye contact with anyone, her hands trembling slightly despite her forced posture of aristocratic superiority.

At the center of the defense team sat Richard Sterling, looking smug and composed.

Judge Evelyn Harper took the bench, her sharp gaze scanning the crowded room before resting on the defense. “We are here for the arraignment and bail hearing for defendants Blake Mercer and Judith Mercer. Prosecution, state your position.”

The Assistant District Attorney, Marcus Vance, stepped forward. “Your Honor, the state requests that both defendants be held without bail. Blake Mercer is charged with aggravated domestic assault, felony witness tampering, and grand larceny. Judith Mercer is charged with conspiracy, obstruction of justice, and evidence tampering. Furthermore, both defendants possess significant financial resources and offshore connections, making them extreme flight risks.”

Judge Harper nodded slowly, turning her eyes to Richard Sterling. “Mr. Sterling, your response?”

Sterling stood up smoothly, buttoning his jacket. “Your Honor, this entire case is built on a hysterical narrative pushed by a grieving, mentally unstable woman. My clients are pillars of the community. Blake Mercer is a prominent executive; Judith is a renowned philanthropist. The alleged incident in the home was nothing more than a tragic marital dispute in which Mr. Mercer was attempting to restrain an out-of-control spouse.”

He gestured toward me. “Mrs. Mercer has a documented history of severe psychological instability. She has orchestrated this public prosecution purely to wrest control of Caldwell Restoration from her husband. We ask for a reasonable bail set at fifty thousand dollars each, with surrender of passports.”

I felt a surge of rage burn through my chest, but Victoria placed a calm, restraining hand on my forearm. “Let the prosecutor work,” she whispered.

Prosecutor Vance didn't flinch. He walked over to the evidence table and picked up a high-capacity tablet. “Your Honor, the defense wishes to discuss Mrs. Mercer’s mental stability. However, we have submitted into evidence the live video and audio feed recorded at the scene on the night of the arrest.”

Sterling immediately stood up. “Objection! That recording was obtained without consent in a private residence!”

“The recording was captured by a security device installed by the sole owner of the property, Erin Caldwell,” Vance countered firmly. “Furthermore, under state law, victims of violent crime are permitted to record evidence of ongoing felonies.”

Judge Harper leaned forward. “Objection overruled. I have already reviewed the video footage in chambers, Mr. Sterling.”

The judge looked down at Blake, her face hardening into an expression of profound disgust.

“I watched the footage,” Judge Harper said, her voice echoed through the silent courtroom. “I watched a man corner his injured wife while his mother encouraged him to strike her in places that wouldn't leave visible marks. I heard both defendants explicitly discuss forged medical documents and the deliberate theft of millions of dollars from Caldwell Restoration.”

Blake flinched, pulling his shoulders in. Beside him, Judith swallowed hard, her face turning ashen.

“The sheer brutality and cold calculation displayed in that recording are sickening,” Judge Harper continued coldly. “Mr. Sterling, your assertion that this was a 'simple marital dispute' is an insult to this court.”

She slammed her gavel down once. “Bail for Blake Mercer is DENIED. He will remain in custody at Rikers Island pending trial.”

A collective gasp rippled through the gallery. Blake’s head snapped up in sheer horror. “What?! No! You can’t leave me in here!” he shouted, grabbing Sterling’s arm. “Richard, do something!”

“Order in the court!” Judge Harper barked. “As for Judith Mercer, given her age and lack of prior physical criminal record, bail is set at five million dollars, subject to full electronic monitoring, house arrest, and the immediate surrender of all travel documents. If she steps one foot outside her residence, her bail will be revoked instantly.”

“Five million?!” Judith shrieked, her aristocratic composure completely shattering. “That is outrageous! I am a victim here!”

“One more word out of you, Mrs. Mercer, and I will remand you to custody alongside your son,” the judge warned coldly.

As the bailiffs stepped forward to escort a panicked, hyperventilating Blake toward the holding cells, he looked back over his shoulder at me. Our eyes met. The illusion of his power was completely broken. He was no longer the charming predator who ruled my life; he was just a coward in an orange jumpsuit.

As I walked out of the courtroom beside Victoria, Richard Sterling intercepted us in the hallway, his face dark with fury.

“You think this is a victory, Erin?” he whispered, his voice trembling with contained rage. “You just guaranteed that every dirty secret your father ever had will be dragged into the press. I will dismantle his legacy piece by piece.”

I stepped close to him, looking straight into his eyes without an ounce of fear. “My father was an honest man, Richard. But even if he wasn't... I’m not my father. And I’m certainly not the terrified girl you thought you could crush. Tell Blake I’ll see him at the fraud trial.”
